The project proposes a case study on the process of seeking the recognition and titling of Quilombo communities, within the prescribed by Article 68 of the Federal Constitution of Brazil in 1988. The process undertaken by the State, aims to expedite the remnants of Quilombo communities the respective titles of collective property, delineated in anthropological reports.The field of empirical observation is the Community of Carmo, located in São Roque, SP, formed by descendants of slaves Carmelite Province of Fluminense, self-appointed sons of Senhora do Carmo - "The sons of a prayer only" - which unfolds the process of transformation of the group as the subject of a new set of rights: the emergence of the descendants of slaves of Nossa Senhora do Carmo. It is the possibility of access to a collective right, ethnic and territorial, which refers to the construction of identity, in so far as the constitutional provision presupposes the emergence of quilombola identity, despite the ressemantização the concept for the applicability of law. In this sense, the proposal will reflect on the dynamics of identities, religious, political and legal, through the accompaniment of a ethnically distinct group against the new horizon of rights, which demand a legal framework for certain categories, which leads, in time, a reorganization in the community, both internally and externally, while social and political actor, and thus to respect the legal regulation of identity and paradoxes of adequacy.
