Abstract

The present study will analyse the incidence of social control system from Labor Law on the exercise of strike rights in Brazil. The starting point of investigation is the striker process of oil workers in 1995. The analysis of this event should provide induction outlines about the actual Brazilian State conformation regarding the effectuation of fundamental right to strike. On other way, this conformation will be observed by deduction from the form as the countries deal, historically, with the exercise of this right. With this stated theoretical framework, it will be possible faces the conceptual debate about the striker phenomenon striker, drafting a own formulation that guides the studies. Thereafter, the investigation goes forward to the examination of regulatory legislation and the jurisprudential understantings regards the striker rights, identifying the juridical obstacles to effectuation of this right, as well as proposals of building a system of democratic social control of Labor Law.
