The master plan of Bauru and the statute of the city: a case study

Abstract

This research takes as its object of analysis the Master Plan of Bauru (Municipal Law N. 5631 of 22.08.2008), compared to normative statements of the Statute of the City (Federal Law N. 10.257/2001). Based on rigorous inventory descriptive and analytical, it is analyzing the instruments of this federal law incorporated into municipal law in its Master Plan, including any specific rules later. In terms of methodology, tools and devices adopted will be grouped into two dimensions: a) urban policy instruments that can potentially interfere with the production dynamics of urban space and its possible impacts, and b) participatory tools in decision making of public policy. This process unfolded between 2005 and 2006, and its bill took 23 months to become law, evidencing the political and institutional obstacles in their decision process, whose examination also requires a careful restoration, both on the more controversial items (such as Awarding the Right to Build costly by relaxation of the coefficient of Utilization Basic) and those who were eventually changed by the Legislature and / or vetoed by the Executive. Important to clarify that this project is part of a larger study funded by FAPESP, "Proceedings of contemporary urban development in medium-sized cities: the City Statute, housing boom, gear dynamic economic and political-institutional decision-making [2001-2011]" (Case 2011/14082-3).
