Abstract

Although the consortium of companies has emerged in Brazilian corporate practice in the middle of the last century, there is no sedimented analysis about the way they are used in reality. This is due to the remarkable doctrine vacuum on the topic since the 80's and due to its general legal discipline to have shown itself superficial and attribute to the consortium companies ample scope for regulating the operation of the consortiums. The goal of this research, through opposition of theoretical and practical considerations, is to perceive how consortiums function, especially in regard to the discipline of the consortium fund and the tort law regime of the consortium and consortium's companies, establishing a current outlook on the potential of this figure as a tool to national economic development.
