Abstract

This project aims to analyze the impacts of regalism Pombal in judgment to the bishopric of Sao Paulo, in the period 1747-1822, seeking to emphasize the changes in legal practices and in ecclesiastical jurisdiction, especially in the trial of cases involving clerics. The hypothesis that we test for is that, because of the process of "secularization" of the Church and of the restriction of the jurisdiction of courts, the exercise of Episcopal Church justice incorporated regias practices, both by the use of the laws of the Kingdom and the appeals to Metropolitan instances, in other words, through the exercise of Royal Justice in cases of ecclesiastical jurisdiction.To this end, we will examine the processes-crime tramitaram in ecclesiastical and judgment we will classify the processes according to the offenses, appeals and the actions the other legal spheres (Regia and inquisitorial); which will allow to point the exercise of jurisdiction in cases of Regal ecclesiastical Forum. The timeframe of this research begins in the year 1747 with the establishment of the episcopal Court of São Paulo and the first bishop of the diocese of São Paulo, d. Bernardo Rodrigues Nogueira and concludes in the year 1822 during the administration of Bishop d. Mateus de Abreu Pereira who developed - according to Arlindo Rubert, Vasco Vasconcelos and part of the historiography episcopate paulista-an administration of liberal character and focused on the political problems of the province to the detriment of subjects ecclesiastics.
