Abstract

The European Union has shown an important normative power in sustainability issues in the world. The case of bio-energy clearly shows that leadership and its spillovers effects. This study aims to analyze through the perspective of comparative law what were the necessary changes in the regulatory framework in some countries members of the European Union to enter the targets proposed by the European Commission and the harmonization processes of sustainability criteria in progress. Will be chosen two countries the first one is Italy which has the same Germanic Roman base of the Brazilian law and source of the Brazilian agrarian law and Germany due to the important local experience with ISCC and its leadership on these issues. This analysis will be the basis for the development of the central objective of the research that aims to propose changes in the Brazilian regulatory framework, for a better match in implementing more complex certification processes, as the case of biofuels.
