"I, Francelina Juguleto, who, together with my daughter, killed my husband": the production of the female body by criminal discourses and female counter-conducts (RS, 1940)

Abstract

The starting point for this research was a crime that occurred in 1940 in the small rural community of Benjamin Constant, located in Erechim, a countryside city of Rio Grande do Sul. This is the crime committed by Francelina França Juguleto, who, together with her daughter, killed her husband with a pestle hand. The case shocked local authorities and residents and was documented in the criminal process that was installed after the homicide. Based on this source, I try to understand the criminalist discourses that were activated in order to criminalize the accused and constitute her as an abnormal and delinquent being; and, on the other hand, paradoxically, to absolve her by the argument of legitimate defense of honor. Furthermore, I intend to understand the power networks that permeated female subjectivities and which subjected women to an ideal of femininity and docility to which Francelina clearly did not correspond. Therefore, I understand Francelina's actions can be read as female counter-conducts that, in the wake of Michel Foucault and the feminist theory, show how the constitution of subjectivities never is simply a submission to instituted gender models, but a becoming that happens between ways of subjection and transgression.
