Abstract

he condition of person in connection with the street is seen by society not only as the lack of housing, food, health and other basic needs, but also expresses a condition of marginalization and stigmatization, thus, the condition of the homeless becomes taboo for contemporary society, especially in the Western context. Being, therefore, an issue that surpasses the barriers of the Brazilian reality, it becomes relevant the comparison between Brazil and Portugal, considering the similarities contained in their Constitutions. At this point it is important to understand that the Brazilian Constitution of 1988 and the Portuguese Constitution of 1976 have as common features a broad list of fundamental and social rights, including the notorious influence of the Portuguese letter in the elaboration of the Brazilian Magna Carta (Bercovicci, 2018).This project aims to grant an internship scholarship for research abroad to be developed in Portugal at Universidade Nova de Lisboa for research on human rights, public policies and access to justice, focusing mainly on human rights. social status of the homeless in Portugal. Therefore, the development of the work aims to analyze the public policies developed in Portugal based on the social rights of the homeless population, with the main scope in the proposed case study on the experience implemented in Lisbon to receive homeless people and which has a high permanence rate of the population served. Still regarding public policies, it is necessary to verify the existence of a national coordination plan and its possible guidelines. Regarding access to justice for the homeless population, we intend to quantitatively analyze the data on access to justice by collecting data on the website of the courts of justice of that country.At the end, the research report developed during the internship abroad will integrate the final research report developed in Brazil under the title: "How the Paulista Judiciary Decides Issues of Social Law Relating to the Homeless: The Rights to Housing, Food and Health " Thus, the research developed in Brazil will become more complete and concatenated with the intertext of another national reality. Finally, it is intended that the integration of the final report of research abroad to the general report of the work, there will be a comparison between the points analyzed in both countries and suggestions and proposals should be made as to the institutes used in each country and that can be implanted the reality of the other with the appropriate adaptations. Thus, it is intended that this research does not end merely in the academic world, but that it will be able to dialogue with reality and subsidize the elaboration of public policies and judicial decisions.
