How Brazilian applicants are formed and operate: a study in Geographical Indications of agribusiness

Abstract

Geographical Indication (GI) recognition is granted by the Instituto Nacional de Propriedade Intelectual (INPI National Intellectual Property Institute) to regions that have a unique product or service. The IG strengthens the image and reputation of the product/service in that region, in addition to protecting it against imitations. The first region to obtain GI in Brazil was Vale dos Vinhedos (RS) and there are currently 110 Brazilian regions with GI. For a region's product or service to obtain GI, there must be a formally constituted requesting entity, also called applicant, which can be an association, union or any other entity. After the group of producers receives approval of the Geographical Indication, there must be a process of implementing and maintaining actions to appropriate this benefit. It is observed that there are differences in the mode of operation and/or governance of regions with GI. This research will have a descriptive nature and will be based predominantly on internet searches, scientific articles and documents, seeking to present the formation of the Procedural Substitutes (type of entity) and what actions they have carried out, in addition to interviews. The focus of the study will be GIs related to agribusiness throughout Brazil, aiming to contribute to efforts to adopt GIs in the state of São Paulo, which has 6 GIs, 3 of which are from agribusiness. The project will be related to the doctoral thesis that studies GIs in Local Productive Arrangements of coffee growing in São Paulo and to another high school scientific initiation project that studies the history of regions that received GIs.
