Abstract

The goal of this project is to study some aspects of what it is known as social ontology from the perspective of the theory of illocutionary acts, specially the one following the tradition initiated by Austin (1962) and Searle (1969). More precisely, we will start by analyzing the notion of institutional facts (as the name suggests, it grounds the legal, political and economical institutions) and the main theoretical ingredients needed for its understanding (performative, collective intentionality, constitutives rules, and notion of institution). Furthermore, the project includes the study of social ontology applied to law, that is, of institutional facts within the scope of legal system, specifically in the theory of legal norm. The study will be focused on two seminal studies by Searle (1995, 2007) and in some classical theories of the legal system (mentioned below).
