Abstract

Brazil, nowadays, lives surronded by ghosts of a not so distant and not so democratic past, due to fact that there is a conflict in relation to what extent should the State be presente in the private relations, considering the conservation of economic growth in communion with the welfare of society. This alteration in your composition involves budget and administrative matters, because these are the disciplines that enable and organize materiarly the State and its autarchies. One of the most important laws, in that regard, is the Fiscal Resposability Law which, besides from detailing requirements to be accomplished by the budget laws in fiscal and formal terms, also stabilishes guidelines that the public administration must have in mind reguarding their expenses. In the last years, however, there were many alterations in the FRL which are reflexes of endless constitucional changes related to narrowing or to enlarging of the susceptable budget to be legally accomplished.It is questioned, thereby, what is the influence of those alterations in brazilian democracy's dinamic, because the chances occurred in financial law alterated considerably the way that public policies are executed. These policies must attend stabilished constitutional objectives, mainly, in relation to social rights, but also must have in mind the State's financial sustentability. The present research, therefore, aims to study how public budget is an important instrument which makes viable the functioning of the interventionist State, taking into account its relation to legimicity and to achivement of the State's socioeconomic purpose.
