Responsibility while Protecting (RwP): normative entrepreneurial initiative as a complementary form of humanitarian contribution

Abstract

The norms of humanitarian intervention are structured within an international normative and political context. In the post-Cold War scenario, followed by the historical events of mass atrocities against civilians in the 1990s, the standards and the debate on humanitarian interventions have gained notoriety. At that juncture, the principle of Responsibility to Protect (R2P) emerged in 2001, through the elaboration of the International Commission on State Intervention and Sovereignty (ICISS), and was consolidated as a principle of international law in 2005 at the UN World Summit. Its turning point came through Resolution 1973 in 2011 - issued by the Security Council - which resulted in the intervention in Libya, in response to the excesses and failures that occurred during the implementation of the resolution. Brazil in an initiative as a normative entrepreneur, proposed Responsibility while Protect (RwP). In this sense, the present work aims to identify how this RwP normative proposal fits into the vast panorama of the evolution of humanitarian intervention standards, that is, in the international political and normative environment. Therefore, the RwP shall be approached as an example of a normative attempt immersed in the international scope of the standards on the use of force, emphasizing its propositional character due to Brazil's lack of effort to consolidate the concept within the framework of the United Nations.
