Institutional reform policies promoted by multilateral investment banks: collaboration or intervention?

Abstract

The objective of this project is to analyze the relationship between states, corporations and multilateral international organizations, a topic of great relevance to the current political reality. In particular, it will address the role that so-called "multilateral development banks" have played in reforming the institutional and legal systems of many developing countries, aiming to promote the improvement of their economic and social indicators.In this context, "reform of legal systems" refers to the broad movement for the modernization of the structure and functioning of institutions and norms of a state or society, including: a) The reform of procedures for drafting and amendment of laws: it is the case of, for example, reforms of the constitution, statutes and codes, as well as movements of normative transplants, the use of model laws and deregulation of economic activity; b) The political and administrative reorganization of the Judiciary, including issues of reduction or enlargement of its powers, the limits to the power of judicial review, the reorganization of the structure of separation of powers and the use of alternative dispute resolution, and c) The adoption of measures to modernize the judicial structure of a state, such as expanding the number of courts and judges, technological and training structures, recycling education of the Judiciary and increase access to justice. Best known examples of these initiatives are found in various projects sponsored by the World Bank, the Interamerican Development Bank (IDB), the European Bank for Reconstruction and Development (EBRD), the African Development Bank (AfDB) and the Asian Development Bank (ADB). As a rule, these organizations engage in these projects through agreements with local governments or private entities, providing not only financial support for its implementation but, more importantly, technical support through internal and external consultants with a view to proper implementation of reforms. Conversely, these funding agencies generally require local governments or of the beneficiaries to undergo a rigorous supervision during project execution and fulfillment of other obligations that may result in certain economic, social or political constraints.
