Abstract

It aims to identify and characterize judicial and non-judicial actions adopted by the "Ministério Público"(MP) to monitor and intervene in contracts between municipalities of São Paulo state and educational companies, to acquire "sistemas de ensino", focusing on analysis of three specific cases. The reconfiguration of the Brazilian state, taken from the 90's, also reconfigured the landscape for educational policies, allowing new arrangements between local executives and educational companies through public-private partnerships. The public prosecutors, meanwhile, has adopted judicial and non-judicial actions that are impacting on the adoption of these partnerships. In this sense, the question arises whether these actions generate consequences for municipal educational policy and for the public prosecutors as states agents of social control. Initially, the research will be delineate between the years 2003 to 2010, since it is from the original date that we know about the first suit filed by public prosecutor, and that the close date allow us betters analysis of the judicial processes adopted.
