Abstract

The Federal Constitution of 1988 raised the balanced work environment to the level of fundamental right, ensuring healthy and safe labor-environmental conditions for all workers, regardless of the activity and the legal relationship established. The State, through its organs, has the difficult task of enforcing compliance of agreed norms to protect the life and health of workers. In this context, it justifies the importance of the Public Ministry of Labour on the protection of the labor environment, it's the most important agency guarantor of worker health when noncompliance with the standards established by the Ministry of Labour and Employment. However, the number of occupational accidents and diseases in the country continues to grow, especially mental disorders. This research aims to analyze the role of the Ministry of Labor in the realization of the fundamental right to a balanced work environment, focusing on possibilities of action and key challenges faced by the Prosecutor's Office of Ribeirão Preto (linked to the Regional Attorney Labour of the15th Region), responsible for about 60 cities around Ribeirão Preto. For this purpose, the technique of literature will be used, and the method of data collection through interview technique for guidelines. Data will be analyzed using inductive and analytical-critical methods.
