Abstract

Sex workers are characterized as a socially and legally marginalized group, because their demands for labor-related payments and adequate working conditions remains impaired towards the Labour Court due to the illegality of the contractual object that makes it impossible to recognize a employment bond, but also because of idiosyncratic aspects such as misinformation. Thus, the project aims to analyze the legal, jurisprudential, cultural and biopsychosocial factors related to the access to justice by sex workers and their impacts on a balanced labour environment. As procedural methods, bibliographic research will be adopted to analyze published materials, as well as jurisprudence research technique to identify legal and jurisprudential factors, in order to understand the interpretation about the legality of the sexual profession and the possibility of recognizing it as a labor, as well as its influence on the recognition and protective execution of labour and fundamental rights of sex workers by the Brazilian Courts; and the interview technique to analyze the cultural and biopsychosocial factors. And, as methods of procedure and approach, the deductive method will be adopted for bibliographic research; the content analysis method and the inductive one, regarding the research in precedents; and the content analysis method to the interviews; seeking to assess the impact that the difficulty of access to justice has on the construction of an adequate labour environment and in fortifying the fundamental rights such as freedom and professional equality.
