Abstract

This research project proposes to examine the discussion of educational quality in the judiciary, based on the analysis of the American experience with the adequacy litigations, a type of educational litigation which aims to guarantee an education with at least a minimum level of quality for all children. In order to enable the achievement of the proposed objective, it will be held bibliographic and documentary research with qualitative approach. The documentary research will be conducted based on the analysis of judicial decisions issued by the Supreme Courts and Courts of Appeals of the American states that took part in adequacy litigations from 1989 to 2014 Through the analysis and interpretation of these decisions court, the objective is to identify the definitions of educational quality adopted by the Courts of the United States; what paths were adopted by the Cortes of this country to secure it and analyze how these lawsuits quality echoed in the educational policies of the United States in recent decades. Thus it is expected that some of the issues raised in the debate about the legal enforceability of educational quality in Brazil become clearer and the research proposed here can enrich the debate on the issue in Brazil.
