Abstract

After extensive period of capital accumulation occurred at the stage of expansion and consolidation of capitalist accumulation regime of Taylorism and Fordism period capitalism experienced a phase of structural crisis that only found a solution, from the 1980s, through a long restructuring process. With the consolidation of the restructuring process was inaugurated a new paradigm of capital accumulation which reorganized labor relations focusing expressively on relations of exploitation of labor and consequently the relations of exploitation genre. Although the 1988 Federal Constitution to ensure equal rights and obligations between men and women social relations daily show that such provision is not particularly effective since, historically, women's labor is exploited under the aegis of gender. In this context we visualized in recent decades the dynamics of work's domiciliation, especially in low technology activities, highlighting the exploitation of female labor performed mainly in the home due to the facilities of more flexible hiring schemes. Therefore, labor relations experienced a process of flexibilization of work allied to outsourcing contracts in which workers had to submit to the precarization of labor law itself. Accordingly this research will seek to understand the emergence and development of the phenomenon of work's domiciliation in industrial pole of Franca/São Paulo with special focus on the dynamics of the feminization of seamstresses shoes labor seizing the role played by Law in labor relations and its ability to safeguard the work in the face of contemporary transformations due to the restructuring process. To this end the assessment of jurisprudential elements will take place seeking to understand the role of Law in the face of social conflicts arising from the restructuring of the working world as well as bibliographic among the Social Sciences and Law literature in order to find elements that can contribute to the improvement of the analysis to be performed.Keywords: Economic restructuring.
