Abstract

Public security is one of the most sensitive areas in the context of Brazilian society. Not without reason. The situation experienced today in the country can be called "homicide epidemic": according to preliminary data from the Ministry of Health, only in the year 2014, 59,627 people were victims of homicide in the country, a rate of 29.1 violent deaths per 100,000 inhabitants. This rate is remarkably high, compared to the world average of 6.9 homicides per 100,000 inhabitants. The victimization by homicide is one of the leading exponents of the phenomenon of violence, both by the severity of their individual and social consequences, and the increasing rates. Since the 1980s homicidal violence has increased quite regularly but, despite the relative antiquity of the problem, the State has been ineffective in containing the spiral of violence. Given the importance of homicide practices in the context of the problem of violence in general, considering its repercussions both in the interpersonal relations and within society in general, we propose an analysis of the (in)effectiveness of the criminal policy of homicides the Brazilian legal system. particularly about the determining factors, in order to be a reference for the elaboration of more effective public policies, especially legal. Therefore, we intend to conduct a qualitative research, analyzing the significant increase in homicide rates in recent decades, and criminal policies of the Brazilian legal system, in executive and judicial level, combining the literature research and the research of statistical documents and formulation and implementation of criminal policies documents.
