Abstract

This work aims to recover the files and the North American case compilation known worldwide as Roe vs. Wade; one of the largest and most controversial trials in history, a global framework of decriminalizing abortion. As the culmination of the discussion, the Supreme Court of the United States decided that most US laws that criminalized abortion violated the American Constitution itself. This research is relevant , in particular, the almost complete absence of references , few articles in national bases on this icon decriminalizing abortion and affirmation, as a fundamental right of human rights of women. This research will proceed according to the historical method, proposing to descriptively report any discussion held by the Supreme Court of the United States of America, in particular the reasons for the decision (ratio decidendum) said that women's rights as constitutional rights.
