Abstract

The Outorga Onerosa do Direito de Construir (Onerous Grant of the Right Build) is an important policy and urban planning instrument which began to be debated in Brazil in the middle of 1970s, culminating in its regulation in the Federal Law 10.257/01, known as City Statute, in the early of the first decade of the 21st century. Understanding how this instrument has been applying in the Brazilian cities is a necessary task for its appraisal and enhancement, especially considering its capacity and nature to objectivize the land value capture or, in other words, the social management of the urban land valuation. In this sense, the objective of this research project is to investigate the process of formulation; regulation and application of the Outorga Onerosa do Direito de Construir in the city of São Paulo, aiming to understand the dissensions and consensus, the ruptures and continuities in the formulation and operationalization of this tool, considering the constituents elements of the calculation formula and the method and object of the compensation charging. In addition, the aim is also to understand how the management and allocation of the resources by the Urban Development Fund corroborate to the instrument will be, in fact, effective in the land value capture and will assume a redistributive role. Thus, this research project focuses not only on the investigation of the tool, but also seeks some scrutiny on the relationship between the formulation of the tool and its real ability to capture land value.
