The onerous grant of right to build between the urban dimension and the collecting dimension: the case of São Paulo

Abstract

This dissertation proposes to investigate the process of formulation, regulation and application of the Onerous Grant of Right to Build (Outorga Onerosa do Direito de Construir) in the city of São Paulo, intending to understand the relationship established between the urban dimension, in other words, the capacity of the instrument to act in urban planning, and the collecting dimension, namely the capacity of collection of the instrument with the objective to being a new source of funding for the financing of urban infrastructure. Therefore, it focuses on the study of the case of São Paulo from two complementary directions. The first one is an analysis of the evolution of instrument regulation; and the second one is the examination of the empirical data on its application in the municipality. The central argument of the research is that the urban dimension and the collecting dimension are related, therefore inseparable, since only collect (or recapture urban land value) if there is material production of real estate. In addition, the research seeks to make an empirical analysis of the impact of the planning and the social interest factors on the formula for calculating the Onerous Grant. The available data allow us to infer little about the strategy adopted by this policy of subsidies (or discounts in the counterpart) for certain uses and densifications. The difficulty of measuring the volume of square meters and the projects that received exemption from payment for Social-Interest Housing, combined with the identification of considerable economic stimuli to the Moderate Income Housing, indicate that, from the social, urban and economic point of view, urban policy ends up grating considerable economic stimulus to the non-priority or transforming uses of the unequal city we find today.
