Abstract

This research aims to identify how initiatives using the institute numerus clausus ("one inmate for each place ") have been used as a means of limiting prison overcrowding in some states of the Federation. Considering the Resolution No. 05/2016 of the Conselho Nacional de Política Criminal e Penitenciária (CNPCP) - which provides for indicators for setting maximum levels in penal establishments - recommends measures to be adopted by all States of the Federation, this research seeks to understand in depth the experience of interdiction of overcrowded prison units located in Aparecida de Goiânia, Goiás. In addition, it will be studied the alternative to overcrowding developed in the State of Paraná, where occurred the elaboration and implementation of the project called "Ocupação Prisional Taxativa", linked to the Judiciary. To do so, this research will use as a methodological strategy the case study, to be developed based on a documents and interviews with the actors involved in the construction and implementation of these initiatives.
