Judicial, prison and life labyrinths: a case study on the management of women's sanctions in the state of São Paulo

Abstract

This work investigates an unintended judicial biography, based on a single case study, the "Eliane case". This research mobilizes different methods, especially the document analysis of judiciary archives, in order to investigate the trajectories of a woman inside São Paulo's justice system. It aims to comprehend the arrangements involved on these dynamics and also in the interface between the fields of law that are involved in the case, especially those referring to time management of prison sentences, in-between times and at home, as well as in the areas of childhood and youth and administrative law. In this regard, this research, which looks to punishment based on the perspective of those who live it, needed to simultaneously consider all the sanctioning components involved in the case, which when viewed from the perspective of the justice system, were framed in a labyrinth of sanctions management, involving judicial, prison and life practices. From an analytical perspective, the findings of Eliane case point out that, although it is a unique a singular trajectory in the justice system, it is inevitable that in face of the extent of the Brazilian prison system, many other lives are traced by the same labyrinths, even if facing distinct sanctioning components.
