ILO Convenctions 138 and 182 and its effectiveness: analysis of the inspection actions of the Ministry of Labour and the work of the Labour Justice in São Paulo State

Abstract

Brazil undertook, through its Agenda 2030, the commitment to eradicate all forms of child labor by 2025. Despite this commitment, the rates of early work in the country remain alarming, according to data from the National Household Sample Survey (PNAD) of 2015, there were 2.7 million children between 5 and 17 years old working in Brazil, that 79 thousand had between 5 and 9 years and 333 thousand had between 10 and 13 years, at which age any work is prohibited. In order to systematize actions aimed at the eradication of precocious work, Brazil developed the National Plan for the Prevention and Eradication of Child Labor and Protection of the Adolescent Worker, where it identified as critical node the insufficient knowledge of the reality of child labor in the national territory, establishing, as one of the solutions, the accomplishment of mappings at the municipal and state level. Taking into account this need for greater knowledge of the regional specificities of child labor, the present research was proposed, establishing as a focus, as a way of making the mapping feasible, the work of the former Ministry of Labor and Labor Justice in São Paulo State. It was based on an essentially quantitative approach, using the bibliographic, documentary and field research methods in the Special Courts of Childhood and Adolescence (JEIAs) and the Auxiliary Court of Children and Youth (JAIJ). Thus, it sought to contribute with the greater knowledge of the singularities of child labor in the São Paulo State, in order to allow future specific public policies to be draw. (AU)
