Abstract

ABSTRACT This article presents some of the current equations and effects of the so-called Restorative Justice (RJ) in children and young people. Firstly, it questions how the selectivity of the penal system operates in the continuum produced by RJ, which articulates the prevention of conflicts and new penalties, moving between Childhood and Youth Courts, schools, neighborhoods, and communities in favor of the construction of safe environments. Secondly, the article focuses on United Nations (UN) guidelines on RJ in Brazil. Once the UN human development approach establishes that investments in human capital must be applied from childhood, also through the promotion of resilience and combating so-called vulnerabilities - key concepts for the restorative methodology as formulated by the UN -, the article discusses the extent to which this RJ format is aligned with the neoliberal rationality based on a security approach to life.
