Abstract

This research aims to analyze the response of Brazil to TRIPS Agreement (Trade-Related Aspects of Intellectual Property Rights) of the World Trade Organization (WTO), which requires the countries grant national protection of intellectual property rights in varieties. We intend to understand the factors which determined Brazil's access to the International Union for the Protection of New Varieties of Plants (UPOV), since the flexibility of TRIPS would allow the adoption of other forms of protection. It is necessary to study the general guidelines of the Brazilian foreign policy from 1980 to 2002, focusing, in addition, on placement of Brazilian diplomacy in international negotiations on intellectual property since the process of incorporation of TRIPS until the access of Brazil to the UPOV. Finally, we seek to evaluate some impacts caused by the Brazilian actions from the establishment of the National Law of Cultivars in 1997. (AU)
