Abstract

During the 2000s, the United States signed most of the preferential trade agreements that are currently in force for itself; all such agreements contain chapters about intellectual property rights. Our aim is to investigate this US strategy, focusing both on its political aspect and on its legal outcome. Regarding the political aspect, we will consult the specialized literature to identify what was the US preference about the link between intellectual property rights and trade underlying the aforementioned strategy; once this preference is delimited, we intend to discuss it with a view to the theoretical presumptions about the characteristics of negotiations and of the compliance to agreements intrinsic to two kinds of cooperation: the bilateral arrangements and the multilateral ones. To analyze the legal outcome, we will compare, both among themselves and with the TRIPS Agreement, the chapters about intellectual property of the preferential trade agreements signed by the United States during the 2000s, highlighting their differences and similarities to the multilateral agreement and the peculiarities of each chapter as well. Bearing in mind that the international agreements result from the states' actions to pursue their preference, in our final discussion we intend to articulate the step focused on the political aspect to the one focused on the legal aspect, in a way that generates a critical interpretation of the link between intellectual property and trade that was established in the preferential trade agreements signed by the United States during the 2000s.
