Abstract

The research aims to analyze the (in)accessibility to justice for children and adolescents who seek the Judiciary in cases of child sexual abuse. The literature on the subject reveals that this violence occurs, in general, in families and that the lack of technique in the Judiciary is the main obstacle to the protection of this group, notably female victims. In view of this finding, the work will intend to investigate the profile of judicial responses in districts of the Judicial Court from São Paulo on child sexual abuse between 2010 and 2020 and the impact of access to justice for these responses. For this, we determined as a general objective the analysis, from models of access to justice, of the results from statistical study of the variables indicated by the literature as important to understand sexual abuse of children and adolescents. As specific objectives we propose to i) categorize the judicial decisions collected according to variables identified by the literature as important in this type of process; ii) interpret the participation of the Judiciary within the jurisdictional structure in the protection of the sexual dignity of children and/or adolescents; iii) to produce inferences from the results of the statistical analysis of the relationships between variables indicated as relevant by the bibliography and by the normative framework on the rights of children and adolescents. The methodology adopted will be the empirical one through the analysis centered on the study of variables to be carried out through statistical regression in three stages: presentation of the normative and theoretical framework, formulation of the conceptual map and jurimetric analysis. We hope that the results can provide support to contribute to the field of research and protection of the rights of children and adolescents. (AU)
